The parties agree:

1. The Responsible Party agrees to pay The Owner a damage and security deposit (deposit) of $750.00 to confirm the reservation. The deposit is due when making the reservation. Your reservation is not confirmed until receipt of this agreement and the deposit.

2.Responsible party agrees to pay the Owner the rental price of: $_________/month plus $_________/additional fees for a total of $_________.

50% of this amount must be received 60 days prior to check in date. Full payment must be received 45 days prior to the check in date (60 days for any of your occupancy dates occurring between 12/15 - 1/05). This rental price is in addition to the deposit. Payments must be in U.S. funds and may be in the form of a personal check, cashier’s check, money order or certified check. Personal checks will only be accepted if received MORE than 45 days prior to the check in date, however if any checks are returned for NSF there will be a $50.00 service charge. Once final payment has been received, keys will be mailed out to the responsible party. If your payment is not received by the due date, your reservation may be subject to cancellation and the deposit may be forfeited.

3. The deposit will be refunded only after a thorough inspection of the property has been made and the keys have been returned via US mail. This deposit will be returned within 30 days of your departure from the unit less any monies withheld for damages, missing items, toll calls or excessive cleaning fees. There will be a $25.00 fee applied for lost keys.

4. Check in time is 4PM. Check out time is 10AM. Please use the checkout procedure sheet located in the information binder in the living room to ensure that you cover all points and receive your deposit back.

5. Cancellation policy. You have the right to cancel your reservation with a minimum of 45 days written notice (60 days required for any dates in your stay falling between 12/15 and 1/5) of your check in date and receive a full refund less a $75.00 cancellation fee. Should cancellations occur after full rent has been paid, only the deposit money shall be refunded once the keys have been returned. If we are able to re-rent the property for any of the same dates, we will refund that portion of the rent collected to you, less a $75.00 cancellation fee.

6. There will be no smoking and no pets allowed.

7. Please limit the use of the telephone to toll free calls, local and domestic long distance only. Use your credit/calling card or call collect when making international long distance calls. All inbound and domestic outbound faxes are complementary. Internet usage is also complementary, but please refrain from consuming food and drinks while using the computer. Any cost of international toll calls made during your stay plus a $20.00 collection fee will apply and be deducted from the deposit.

8. Guests and all other occupants will be required to vacate the premises and will forfeit the rental fee and security deposit if any of the following occur: Unreasonable damage to the residence or any of the neighboring properties. Possessing, serving, or consuming alcoholic beverages by or to persons less than 21 years of age. Using the premises for any illegal activity. Any acts which interfere with neighbors right to quiet enjoyment of their property. Having pets in or around the premises.

9. The additional parking area must be cleared of snow after each plowable snowfall, therefore, cars must be moved to a clear area in order that the lot be plowed. In addition, cars may not be parked in the additional lot for longer than 120 consecutive hours.

10. Security and contents of home should be maintained just as you would your own home. Please remember you are renting a private home that we are very proud of. You are responsible for your own personal property as well as the contents of the home. Please lock the doors and windows when you leave each day and put all equipment away.

11. We make every effort to ensure that all equipment within the unit is maintained and in working order. Occasionally, breakdowns do occur. In the event of a malfunction, we will strive to repair it as soon as possible after notification. We cannot guarantee that spas, grills, televisions, appliances, etc., will not break down during your stay and therefore, no refunds or adjustments will be made for mechanical failure.

12. Responsible Party will not assign this Agreement, or sublet the home/unit. They also represent that all members in the party staying in our home are related by blood or marriage as required by our home owner association documents.

13. The responsible party hereby acknowledges that the home being rented includes a hot tub and is fully aware that the tub and surrounding areas can be hazardous and slippery when wet. Injuries may occur and the responsible party assumes all risks involved in or relating to the use of the hot tub and surrounding areas. We reserve the right to additional compensation for any damage or excessive cleaning required to the hot tub caused by the responsible party or any member of your group, or guests.
